Terms of Service

1. Acceptance of Terms

By using PetGuardian ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. We may update these terms at any time; continued use constitutes acceptance of changes.

2. What We Do

PetGuardian uses artificial intelligence to transform your pet photos into stylized character portraits. You upload a photo, select a style, and our AI generates a unique image — complete with a character backstory. The first generation is free. Subsequent generations require payment.

3. Your Content: Uploaded Photos

When you upload a photo:

You confirm that the photo is yours — your own pet, or you have permission to use it.
You grant us a temporary, limited license to process the photo solely for the purpose of generating your portrait. This license terminates immediately after generation.
We do NOT claim ownership of your uploaded photo. We do not store it, archive it, or use it for any purpose beyond the single generation you requested.
Do NOT upload photos of people, illegal content, or anything that violates our content policy (see Section 8).

    ⚠️ Important — No Photo Storage: Your uploaded photo exists only in server memory (RAM) during the 30–60 seconds of processing. It is permanently discarded immediately afterward. We cannot retrieve it later. Make sure you keep your original.
  

4. AI-Generated Images: Ownership & Copyright

Under current legal frameworks in the United States and European Union, works created entirely by artificial intelligence without substantial human creative input are not eligible for copyright protection.

Specifically:

The AI-generated portrait is not copyrightable. Neither you nor PetGuardian holds copyright over it.
You are free to use, share, print, post, and enjoy the image however you like.
We do not claim any exclusive rights to the generated image.
Because AI-generated works fall outside traditional copyright, they exist in a public-domain-like status.
We do not resell, redistribute, or reuse your generated images.

5. Payments & Refunds

Our payment processor is Creem. By making a payment, you agree to Creem's terms of service. Pricing:

First generation: Free (one per browser/device).
Subsequent generations: $2.88 USD each, which unlocks the HD (1024x1024) version of your portrait.

Refund policy: Since the generation is instant and the result is delivered immediately, we generally do not offer refunds. If a technical error prevents delivery, contact us within 24 hours at support@petguardian.art for a refund or re-generation.

6. Service Availability

We strive to keep the Service available 24/7, but we do not guarantee uninterrupted access. The Service depends on third-party AI APIs (DeepSeek, SiliconFlow) that may experience downtime. We are not liable for delays or failures caused by these dependencies.

7. Limitation of Liability

To the fullest extent permitted by law:

PetGuardian is provided "as is" without warranties of any kind.
We are not liable for any damages arising from your use of the Service, including but not limited to: loss of data, technical failures, or dissatisfaction with generated images.
Our maximum liability for any claim is limited to the amount you paid us in the 30 days preceding the claim.
We are not responsible for how you use the generated images. You assume all responsibility for publishing, sharing, or commercializing them.

8. Content Policy — What You Cannot Upload

You agree not to upload:

Photos of humans (this is a pet service).
Photos containing nudity, sexual content, or violence.
Photos that infringe on someone else's rights or privacy.
Photos intended to generate hate speech, harassment, or illegal content.
Photos with embedded malware or malicious code.

We reserve the right to refuse service and block users who violate this policy.

9. Age Requirement

You must be at least 13 years old to use PetGuardian. If you are under 18, you must have parental consent. By using the Service, you represent that you meet these requirements.

10. Termination

We may terminate or suspend your access to the Service at any time, without notice, for any reason — including violation of these terms. The provisions regarding ownership, liability, and content policy survive termination.

11. Governing Law

These terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.
